1935 SUPPLEMENTARY DOCUMENT RELATING TO 1934 AND 1935 COTTON ACREAGE REDUCTION CONTRACT ENTERED INTO IN 1934
I. STIPULATION OF BASIC FIGURES FOR 1935 AND PRODUCERS SUPPLEMENTARY REPRESENTATION AND AGREEMENT
1. The Secretary of Agriculture (hereinafter referred to as the "Secretary") on the 28th day of November, 1934, proclaimed his purpose of continuing the Cotton Acreage Reduction Plan for 1935. The proclamation stated that the percentage of reduction required for 1935 under 1934 and 1935 Cotton Acreage Reduction Contracts is twenty-five percent (25%) of the base acreage, but that the Sec-retary would accept the rental of additional acres not to exceed five percent (5%) of the base acreage and would make rental payments for the rented acres to exceed thirty percent (30%) of such base acreage. The proclamation was given to the general press and copies thereof mailed to each County Committee. This procedure was in accordance with provision of paragraph 1 of the 1934 and 1935 Cotton Acreage Reduction Contract (hereinafter referred to as the "contract"), the serial number of which is given hereinafter and which covers the farm described therein (hereinafter referred to as "this farm"). The contract is therefore in effect for 1935.
2. On January 17, 1935, the Secretary supplemented his proclamation of November 28, 1934, by announcing that 1935 he would accept the rental of additional acres not to exceed ten percent (10%) (instead of five percent (5%)) of the base acreage and would make rental payment on a total acreage of this farm so rented not exceed thirty-five percent (35%) (instead of thirty percent (30%)) of the base acreage, such rental payment on each of the additional acres so rented to be the same rate as for the acres of this farm which in 1934 were rented to the Secretary for 1935.
3. Since the Secretary has prescribed a reduction in the acreage of cotton to be planted in 1935, he shall under paragraph 10 (b) of the contract make payments for the year 1935 similar to those described in paragraph 10 (a) of the contract and accordingly, upon pre-sentation of such proof of performance may be required, will for the year 1935-
(a) Make a rental payment to the producer on each of the acres of this farm rented for 1935 of three and one-half cents 3 (3 1/2 ¢) per pound on the average yield of lint cotton per acre for this farm for the years as fixed under Administrative Ruling No.1, Form No. Cotton 5, with a maximum rental of eighteen dollars ($18) per acre (subject to the provision of paragraph 5 (a) below, if said paragraph is applicable), and
(b) Make a parity payment upon the farm allotment for this farm of not less than one and one-quarter cents (1 1/4 ¢) per pound on said farm allotment.
The rental payment will be made in two equal installments, the first of which shall be made between March 1 and april 30, 1935, approximately, and the second of which shall be made between August 1 and September 30, 1935, approximately, and the parity payment shall be made at the time of the second installment of the rental payment, if practicable, or between December 1, 1935, and January 1, 1936, approximately.
4. There are shown hereinafter the producer's name and address. In the following table are entered in item (a) the base acreage of this farm and in item (e) the adjusted yield per acre, both as entered on the Notice of Acceptance (Form No. CR-Cotton-201) of the 1934 and 1935 Cotton Acreage Reduction Contract, or on the Schedule of Contracts Approved (Form No. CR-Cotton-203); in item (b) the percentage of the base acres previously rented by the producer to the Secretary for 1935, together with whatever additional percentage (not exceeding ten percent (10%) of the base acreage) is hereby offered by the producer to be rented for 1935 to the Secretary; in item (c) the number of acres of this farm rented for 1935 by producer to the Secretary, which was computed by multiplying the base acres, item (a), by the percentage rented (25% plus whatever additional percentage is offered), item (b), and is expressed in whole acres unless, in accord-ance with Administrative Ruling No. 10, Cotton 106, the producer is renting to the Secretary one hundred percent (100%) of his base acreage; and in item (d) the acreage that the producer will be permitted to plant on this farm for the crop year 1935 as the contract now stands or as it will stand if additional acreage hereby offered for rental is accepted by the Secretary, and which was computed by sub-stracting the rented acres (25% of base acreage plus whatever additional acreage is offered), item (c), from the base acres, item (a). The producer represents that said figures are correct and agrees that they furnish the basis for performance in 1935 and for payments to be made for performance in 1935 under the contract.
It is stipulated that upon its acceptance by the Secretary this document shall constitute a part of the contract documents relating to the contract bearing the serial number indicated hereon and that no notice of such acceptance need be given by the Secretary unless additional acreage for rent in 1935 is offered herein. If additional acreage for rent in 1935 is offered herein, such offer will become binding as a part of the contract bearing the serial number indicated hereon, as extended for 1935, upon acceptance by the Secretary of the offer of such additional acreage by placing of the Secretary's Notice of Acceptance in the regular course of mailing. If no additional acreage is offered to or accepted by the Secretary, this instrument shall not modify or otherwise affect the obligations or rights of the parties or the authority of any person to receive payment under the contract, except to the extent that, pursuant to the provisions of the contract and the Administrative Rulings, there is stipulated in paragraph 5 (a) hereof a division of parity payment to be made hereunder for 1935 and/or a person designated in paragraph 5 (b) hereof to receive all rental payment due under the contract.
