Scott Price Distillery,
Chattanooga, Tenn.
Gentlemen:-
I have your letter of Feb. 16th. with reference to
the 16 cases of whiskey seized in the Southern depot on February
2nd, 1914.
We explained the facts attending these shipments to
our attorney and he advised us that the whiskey was subject to seizure. The law provides that if no action to recover whiskey,
which has been seized, is brought within thirty (30) days from
the time of the seizure that "Such liquor shall be destroyed
publicly."
In view of this provision of the law, I, as Mayor,
would not only be subject to criticism, should I agree to re--
turn the whiskey to you, but I would be acting without authority
of law. It is clear from your Statutes that if whiskey is subject to seizure, and is actually seized, that the parties seizing it
have no right to do anything with the whiskey except to publicly
destroy it.
For these reasons I am obliged to refuse the re--
quest made in your letter of February 16th.
